Cosmetic products may not contain certain nanomaterials, including styrene/acrylates copolymer (nano) and sodium styrene/acrylates copolymer (nano). The placing on the market of cosmetics containing such ingredients, for example, will be prohibited from 1 February 2025, but sales will remain possible until 1 November 2025.
The same time limits apply to the use of hydroxyapatite (nano) in cosmetic products that are used for oral hygiene, for example. The maximum permitted concentration in toothpaste, for example, is limited to 10% and in mouthwashes, for example, to 0.465%. The permitted particle properties must be taken into account; only uncoated particles without a modified surface structure with a defined aspect ratio are permitted. The application of the cosmetic product must not lead to exposure of the end user's lungs.
Regulation (EU) 2024/858 amends Annexes II and III of Regulation (EC) No. 1223/2009 with effect from 1 February 2025.
